What Is a Cross-Lease Title?

Cross-lease titles are common in New Zealand. In this arrangement, you don’t own a piece of land outright. Instead, multiple property owners lease the land from each other. Your legal title describes the building you live in (e.g. Flat 1) and defines your "exclusive use" area, but not the land itself like a freehold title would. This structure can be tricky - especially when changes are made to the outside of your home or shared areas. 

If your building’s size or layout has changed but your cross-lease plan hasn’t, the title may be considered defective. That can cause delays with sale, insurance claims or refinancing. Most banks will request a new plan before they lend, and insurance companies may not honour full coverage if the building doesn’t match the title. The good news? Provided your changes were consented and compliant, a surveyor and lawyer can work with Council and Land Information New Zealand (LINZ) to get it fixed.
